Welcome to ImageMagik, a service provided by Arucy Enterprises LLC. By accessing or using our AI-powered media creation platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
We reserve the right to modify these Terms at any time. Continued use of ImageMagik after changes are posted constitutes your acceptance of the modified Terms.

Our services are provided on a subscription basis with different tiers (Basic, Pro, Premium) and operate on a credit system.
3.1 Account Creation: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibility: You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
3.3 Age Requirement: You must be at least 18 years old to use ImageMagik. By using our services, you represent that you meet this age requirement.
4.1 Subscription Tiers: We offer Basic ($10/month), Pro ($30/month), and Premium ($99/month) plans. Each plan includes a specific number of credits and features.
4.2 Credits: Credits are consumed when you use our AI services. Different operations require different amounts of credits. Credits expire at the end of each billing cycle and do not roll over unless explicitly stated.
4.3 Billing: Subscriptions are billed monthly in advance. You authorize us to charge your payment method on a recurring basis until you cancel your subscription.
4.4 Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.
4.5 Price Changes: We reserve the right to modify subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance of the new prices.

6.1 Your Content: You retain all rights to the images and content you upload to ImageMagik. By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing our services.
6.2 Generated Content: For content generated using our AI tools, you own the output, subject to these Terms. However, you acknowledge that similar or identical content may be generated for other users.
6.3 Our Platform: ImageMagik, including our software, algorithms, AI models, website design, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform or its components.
6.4 Responsibility: You are solely responsible for ensuring you have the right to use and process any content you upload. We are not responsible for any copyright or intellectual property violations resulting from your use of our services.
7.1 Uptime: While we strive for 99.9% uptime, we do not guarantee uninterrupted access to our services. Maintenance, updates, and unforeseen issues may temporarily affect service availability.
7.2 Rate Limits: We may implement rate limits, processing queues, and usage restrictions to ensure fair access for all users and maintain service quality.
7.3 Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
8.1 Storage Duration: Uploaded images and generated content are stored for 30 days by default. Premium users may have extended storage options.
8.2 Deletion: You may request deletion of your content at any time through your account settings. Upon account closure, your content will be deleted within 90 days.
8.3 Backup: We maintain backups for disaster recovery purposes. Deleted content may persist in backups for up to 90 days before permanent deletion.
ImageMagik may integrate with third-party services (Chrome Extensions, WordPress plugins, etc.). Your use of these integrations is subject to the third party's terms of service. We are not responsible for third-party services or their practices.
10.1 "AS IS" Service: ImageMagik is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 AI Limitations: AI-generated content may not always be accurate, appropriate, or of the quality you expect. We do not guarantee specific results or outcomes.
10.3 Limitation of Liability: To the maximum extent permitted by law, Arucy Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Arucy Enterprises LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of ImageMagik, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
12.1 By You: You may terminate your account at any time by contacting support or through your account settings.
12.2 By Us: We reserve the right to suspend or terminate your account immediately, without prior notice, for conduct that violates these Terms, is harmful to other users, or is otherwise harmful to our business interests.
12.3 Effect of Termination: Upon termination, your right to use ImageMagik will immediately cease. We may delete your account and content. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
13.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
13.2 Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware.
13.3 Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions or class-wide arbitration.
